在美國，無意開出無法兌付（原因為資金不足insufficient funds或停止支付通知單a stop-payment order ）的空頭支票不屬於犯罪，但是也會產生罰款，例如通常由銀行收取的透支費（overdraft fees），但銀行也出臺了一些透支保護政策，使得不小心開出空頭支票的人無需就此支付費用。在有些情況下，空頭支票的接收方（receipt）會對開票方（sender）索取罰金或要求其支付利息，這種情況發生的前提一般是雙方之間存在某種先前的合同關係（Pre-existing contractual relationship）。
